Privacy policy
1. Data protection at a glance
The following notes provide a simple overview of what happens to your personal data when you visit this website and when you place an order with us. Personal data is all data by which you can be personally identified. You will find detailed information in the privacy policy set out below.
Controller
The controller for the data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is:
Die Container GmbH
Oberweg 6
82008 Unterhaching
Germany
E-mail: info@diecontainergmbh.com
You will also find the contact details of the controller in our legal notice (Impressum).
2. General notes and mandatory information
Legal bases of the processing
Insofar as we obtain the consent of the data subject for processing operations involving personal data, Art. 6 (1) (a) GDPR serves as the legal basis. In the case of the processing of personal data that is necessary for the performance of a contract to which the data subject is a party, Art. 6 (1) (b) GDPR serves as the legal basis; this also applies to processing operations that are necessary for the performance of pre-contractual measures. Insofar as processing is necessary for compliance with a legal obligation to which our company is subject (e.g. retention obligations under commercial and tax law), Art. 6 (1) (c) GDPR serves as the legal basis. If the processing is necessary to protect a legitimate interest of ours or of a third party and the interests, fundamental rights and fundamental freedoms of the data subject do not override that interest, Art. 6 (1) (f) GDPR serves as the legal basis.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the padlock symbol in your browser line.
3. Hosting and technical provision
This website is hosted with an external service provider (host). The personal data collected on this website is stored on the host’s servers. This may in particular involve IP addresses, contact enquiries, meta and communication data, contract data, contact data, names, website accesses and other data generated via a website.
Our hosting provider is:
Hostinger operations, UAB
Švitrigailos str. 34
LT-03230 Vilnius
Lithuania
(where applicable acting through affiliated companies of the Hostinger group, including Hostinger International Ltd., Cyprus)
The use takes place on the basis of Art. 6 (1) (f) GDPR. We have a legitimate interest in the most reliable possible presentation of our website. Where corresponding consent has been requested, the processing takes place exclusively on the basis of Art. 6 (1) (a) GDPR. A data processing agreement (AVV) pursuant to Art. 28 GDPR has been concluded with the host.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are: browser type and browser version, operating system used, referrer URL, host name of the accessing computer, time of the server request and IP address. This data is not merged with other data sources. The collection of this data takes place on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and the optimisation of its website.
Caching with LiteSpeed Cache
In order to shorten the loading times of our website, we use the server-side caching plugin “LiteSpeed Cache”. In the process, static copies of page content are temporarily cached on our web server and delivered when the page is called up again. No personal data is transferred to third parties as a result; the processing takes place exclusively on our own server infrastructure or that of our host. The legal basis is our legitimate interest in providing the website in a high-performance and resource-efficient manner (Art. 6 (1) (f) GDPR).
Product images via a content delivery network (CDN)
Product images and other image content on this website are delivered not exclusively from our own server, but additionally via a content delivery network (CDN), specifically via Amazon CloudFront, a service of Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855 Luxembourg (Amazon Web Services, Inc., 410 Terry Avenue North, Seattle, WA 98109, USA). When the images are loaded, your IP address is of technical necessity transmitted to the servers of the CDN operator so that the content can be delivered to your device. This may involve a transfer of data to a third country (USA). According to its own information, Amazon Web Services is certified under the EU-U.S. Data Privacy Framework or offers standard contractual clauses as an additional safeguard. The use of the CDN takes place on the basis of our legitimate interest in the fast, reliable and globally high-performance delivery of image content (Art. 6 (1) (f) GDPR).
4. Data collection when shopping in our online shop
Processing of order and customer data (WooCommerce)
We operate our online shop with the shop software WooCommerce. When you place an order with us, we collect and process the personal data necessary for performing the contract, in particular: name, billing address and, where applicable, delivery address, e-mail address, telephone number, payment information and details of the products ordered. This data is required and processed for the performance of the contract, for processing your order, for the delivery or installation of the goods, for invoicing and for handling any warranty or withdrawal cases. The legal basis is Art. 6 (1) (b) GDPR (performance of a contract) and Art. 6 (1) (c) GDPR, insofar as we are obliged to retain data, e.g. for reasons of commercial and tax law (including §§ 238, 257 of the German Commercial Code, HGB, and § 147 of the German Fiscal Code, AO).
Within our company, the order and customer data is passed on to the departments concerned with order processing, dispatch/installation and accounting, and to freight forwarding and logistics companies commissioned by us, insofar as this is necessary for the delivery or installation of the containers.

For payment processing by credit/debit card and other payment methods we use the payment service provider Stripe. The provider is Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin 2, Ireland (hereinafter “Stripe”); for certain processing steps a transfer to the parent company Stripe, Inc., 354 Oyster Point Blvd, South San Francisco, CA 94080, USA may take place. In this context Stripe processes, among other things, names, payment data (e.g. card details), IP address and transaction data. The transfer of the data takes place in accordance with Art. 6 (1) (b) GDPR (performance of a contract) on the basis of the standard contractual clauses provided by Stripe, insofar as a transfer to the USA as a third country takes place. You will find further information in Stripe’s privacy policy: https://stripe.com/de/privacy.
Payment processing via PayPal
If you choose the payment method “PayPal”, payment processing takes place via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”). If you select payment via PayPal, the data you entered during the ordering process (e.g. name, address, e-mail address, IP address, telephone number, where necessary, and the data belonging to the order) is transmitted to PayPal. The transfer takes place on the basis of Art. 6 (1) (b) GDPR (processing of the payment transaction) and in our legitimate interest in payment processing that is as smooth, convenient and secure as possible (Art. 6 (1) (f) GDPR). You will find further information in PayPal’s privacy policy: https://www.paypal.com/de/webapps/mpp/ua/privacy-full.
Advance payment/bank transfer
If you decide to pay by advance payment/bank transfer, we will inform you of our bank details in a separate e-mail and ask you to transfer the invoice amount to our account after receiving this e-mail. In this context the data necessary for processing the payment is passed on to our bank, insofar as this is necessary for payment processing (Art. 6 (1) (b) GDPR).

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there (name, e-mail address, telephone number, message), are stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass this data on without your consent. The processing of the data entered in the contact form takes place on the basis of your consent (Art. 6 (1) (a) GDPR), which you give by ticking the corresponding box in the form. You can withdraw this consent at any time with effect for the future, for instance by e-mail to info@diecontainergmbh.com. If you contact us by e-mail or telephone, your enquiry, including all personal data arising from it (name, enquiry), is stored and processed by us for the purpose of dealing with your request. We do not pass this data on without your consent. The legal basis is Art. 6 (1) (b) GDPR, provided that your enquiry is connected with the performance of a contract or is necessary for the performance of pre-contractual measures; in all other cases it is our legitimate interest in dealing effectively with your request (Art. 6 (1) (f) GDPR) or your consent (Art. 6 (1) (a) GDPR), provided that this was requested.
6. Cookies
Our website uses cookies. Cookies are small text files that are stored on your device. Cookies do no damage to your computer and do not contain viruses. Technically necessary cookies (e.g. session cookies for the cart and checkout function) are stored on the basis of Art. 6 (1) (f) GDPR or § 25 (2) no. 2 TTDSG/TDDDG. We have a legitimate interest in the technically error-free and optimised provision of our services. Insofar as cookies are used that are not technically necessary, this only takes place on the basis of your prior consent.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing (Art. 15 GDPR), and, where applicable, a right to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR) of this data. On this and on further questions on the subject of personal data you can contact us at any time using the contact details given in the legal notice (Impressum).
Right to object
Insofar as personal data is processed on the basis of Art. 6 (1) (f) GDPR (data processing on the basis of a balancing of interests), you have the right to object to the processing pursuant to Art. 21 GDPR, provided that there are grounds for doing so arising from your particular situation. If you wish to exercise your right to object, an informal message by e-mail to info@diecontainergmbh.com is sufficient.
Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent that has already been given at any time. The lawfulness of the data processing carried out up to the withdrawal remains unaffected by the withdrawal.
Right to lodge a complaint with the competent supervisory authority
In the event of breaches of data protection law, the data subject has a right to lodge a complaint with the competent supervisory authority. The competent supervisory authority on data protection matters is the state data protection commissioner of the federal state in which our company has its registered office, i.e. the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 27, 91522 Ansbach.
9. Storage period
Insofar as no more specific storage period has been stated within this privacy policy, your personal data remains with us until the purpose of the data processing ceases to apply.
